Salomão aponta problema do destino de dados pessoais em recuperações judiciais

Conhecedor das normas de recuperação judicial e integrante de julgamentos sobre o assunto, o ministro do Superior Tribunal de Justiça Luis Felipe Salomão teme os efeitos de uma eventual reestruturação de empresas privadas que detêm dados pessoais.

“Se o Facebook pedir recuperação judicial, quem fica com os dados de seus bilhões de usuários?”, questionou o ministro nesta segunda-feira (11/6), em evento no Rio de Janeiro.

Ele manifestou a mesma preocupação quanto à reabilitação da companhia de telefonia Oi, que tem informações de milhões de brasileiros.

Em maio, a Câmara dos Deputados aprovou projeto de lei que procura regular o tratamento de dados pessoais, como nome, endereço, telefone e situação patrimonial, obtidos em qualquer tipo de suporte (papel, eletrônico e imagem, por exemplo).

De janeiro a abril deste ano, o número de pedidos de recuperação judicial no Brasil chegou a 518, uma alta de 30% em relação aos 398 registrados no mesmo período de 2017, segundo dados do Serasa Experian citados pelo jornal O Globo. Para Salomão, os dados refletem a crise econômica que o país atravessa.

“Quanto mais se corta crédito, quanto mais se estrangula o funcionamento do mercado, maior será o número de pedidos de recuperação judicial”, apontou o magistrado, citando que a quantidade de requerimentos de falência não é afetada pelo cenário econômico.
